These Terms and Conditions of Use are applicable to the websites operated by Palas Design at which they are posted (the “Sites”). However, some Sites may include features that do not appear on other Sites, and you should see the applicable terms and conditions of use of each Site for any additional terms that may be applicable to the Site. All such terms and conditions are hereby incorporated by reference into these Terms and Conditions of Use. All users of the Sites are subject to these Terms and Conditions of Use.

These Terms & Conditions may be changed at any time. Notification of any such changes will be delivered via e-mail, and the changed Terms & Conditions will be posted on the Sites. As set forth above, it is your sole responsibility to ensure the accuracy and reliability of the e-mail address that you provide, and all our notice delivery obligations shall be deemed completed upon the transmission of the e-mail notice from our system, whether or not any such notice is in fact received or reviewed by you.

Ownership Rights

All materials contained on this website including design products and plans are property of Palas Design, Inc. and are protected by United States and international laws regarding copyrights, trademarks, trade secrets, and other proprietary rights and that these rights are valid and protected in all forms, media, and technologies existing now or hereinafter. Said materials include but are not limited to, information, data, software, text, photographs, videos, audio, logos, icons, drawings, design, selection, collection, arrangement and assembly of design specifications, plans, specifications, products, product offerings, trade concepts, systems, and procedures. No other party shall own or claim a copyright in such materials. You agree not to copy, modify, create derivative works of, publicly display or perform, republish, store, transmit, distribute, remove, delete, augment, add to, participate in the transfer of, license or sell any of the material on our Sites with the prior written consent of Palas Design, Inc., except to temporarily story files that are automatically cached by your Web browser for display enhancements purposes or to print a reasonable number of pages. You understand and agree you may not reproduce, sell, or exploit for any commercial purposes any part of our Sites, access to our Sites, or use of any services or materials available through our Sites. Title nor any intellectual property rights to any information or material on our Sites will be transferred to you for any reason. YOU EXPRESSLY UNDERSTAND AND AGREE THAT ANY COPYING, OR SHARING, OR DISTRIBUTION OF MATERIALS ARE IN DIRECT VIOLATION WITH THESE TERMS & CONDITIONS AND WILL BE PROSECUTED AT THE FULL EXTEND OF THE LAW.

User’s Account

In consideration of your use of our Sites, you agree to provide true, accurate, current, and complete information about yourself, your account owner, and/or your representation on behalf of the account owner. You agree to maintain and promptly update the account information to keep it true, accurate, current, and complete. If you provide any information that is untrue, inaccurate, not current, or incomplete, or in violation of these Terms & Conditions we reserve the right to suspend or terminate your account and refuse any and all current or future use of our Sites.

Purchase of the Hometown Houseplans ©2023 referred to as the “design product” or “product” provides a non-exclusive one time and one time only license to use the included materials such as the project proforma template, construction plans, finish specifications, and marketing materials. You may not assign, sublicense or transfer the license. You may not re-use any part of the design product (for example: for building any additional homes). You shall not authorize or permit anyone else to sell, redistribute, or publish or otherwise disclose the materials to anyone other than contractors, consultants, lenders, or governmental agencies on a “need to know” basis as reasonably required for the building of a single home subject to the license unless specifically noted otherwise in these terms and conditions. You may not modify, alter, or create a derivative work based on the product.

Insurance Certificate

You acknowledge that it is a best practice and agree that you will maintain, and will cause your builder and other contractors involved in the project to maintain sufficient liability and other insurance coverages with insurance companies licensed in your applicable location and will verify by collecting and keeping insurance certificates on file, as required to cover all your obligations as applicable.

Project Schedule Template

You may use the project schedule template to create your own project schedule one time and one time only. You may save a pdf document for print or digital distribution as reasonably required for the building of a single home subject to the License. You may not reproduced, copy, post publicly, share, sell, redistribute, publish the actual Project Schedule Template Document. You shall not authorize or permit anyone else to reproduced, copy, share, sell, redistribute, or publish the actual Project Schedule Template Document.

Project Pro Forma Template

You may use the project pro forma template to create your own project budget one time and one time only. You acknowledge and agree that modifying formulas and locked cells may compromise the quality of your project pro forma. You may save a pdf document for print or digital distribution as reasonably required for the building of a single home as included in the subject to the License. You may not reproduced, copy, post publicly, share, sell, redistribute, publish the actual Project Pro Forma Template or modified template document. You shall not authorize or permit anyone else to reproduced, copy, share, sell, redistribute, or publish the actual Project Pro Forma Template.

You acknowledge and agree that it is a best practice to collect at least 3 (three) separate estimates per trade and/or task. You acknowledge and agree after collecting adequate estimates and completing your specific project pro forma, to at a minimum of one time to review this document with a finance professional and/or representative before starting any construction.

Construction Plans & Finish Specifications

You agree that you will have the construction plans and finish specifications reviewed and approved by a local professional designer and/or engineer before the start of any construction. You may not redistribute, publish, or otherwise disclose the construction plans and finish specifications to anyone other than contractors, consultants, lenders, or governmental agencies and/or representatives other than on a “need to know” basis. You shall not share these materials publicly.

The construction plans and finish specifications illustrate design intent and basic construction detailing. It is your responsibility to ensure that you have obtained the proper professional assistance to provide final construction details and practices. Any use of construction plans and/or modifications by you, builders, contractors, or others is done at your own risk. The construction plans do not include plumbing, heating or air conditioning designs. It is recommended to have local mechanical, electrical, and plumbing professionals provide designs necessary for permitting. Any foundation plan and associated details included in the construction plans are intended to serve as a basic guide for the typical foundation system, not a site or location specific system. You acknowledge and agree to have a local professional and/or licensed engineer review any and all foundation plans. The construction plans and finish specifications do not have an architectural or engineering signature, seal, and/or stamp. You agree to consult local professionals who can provide assistance in determining what requires review by a licensed design professional or engineer to ensure your specific geography and climate, site, building codes, and/or zoning requirements are properly accounted for and met. Construction plans and finish specifications may be modified to comply with local requirements.

The design product provides ideas and concepts and are not intended to be complete in all aspects and details. Variations in brands, standard sizes, types and uses of different materials, different material properties and thicknesses, as well as, varying local codes, ordinances, regulations, foundation requirements, and the layout of electrical, mechanical, and plumbing systems may also change details. Final finish selections of materials are the responsibility of you and/or your builders and/or contractors, including proper installation. You acknowledge and agree that manufacturer specifications and installation instructions should always be followed.

Marketing Materials

You may use the marketing materials one time and one time only to communicate the project with the public and market the project for sale as reasonable to find a buyer. You agree to indicate and disclose photos provided as part of the marketing materials are of a similar property and shall not mislead the public or any potential buyers regarding the finish product of your housing project in any way.

Indemnity

You agree to indemnify and defend Palas Design and hold them harmless from and against any losses, demands, causes of action, damages, liability and costs and expenses, including attorney’s fees, incurred or sustained by Palas Design in connection with the use, construction, conversion, modification, misinterpretations, misuse, or reuse by you or others of the design product or any other drawings, data, or other materials furnished by Palas Design. You agree to indemnify and defend Palas Design and hold them harmless from and against any losses, demands, causes of action, damages, liability and costs and expenses, including attorney’s fees, incurred or sustained by Palas Design in connection with any negligence or other acts or omissions by you or any of your employees, associates, government representatives, consultants, advisors, agents, other representatives, or contractors. You agree to indemnify and defend Palas Design and hold them harmless from and against any losses, demands, causes of action, damages, liability and costs and expenses, including attorney’s fees, incurred or sustained by Palas Design in connection with any breach by you of any of the provisions in these terms and conditions and any applicable agreements.

Interference

You agree that you will not use any robot, spider, or other automatic device, process, or means to access our Sites. You agree that you will not use any manual process to monitor or copy material without prior written consent of Palas Design, Inc. You agree that you will not disrupt the function and/or proper working of our Sites in any way and/or take any action that imposes an unreasonable load on our systems.
